PROCEDURES WITH RESPECT TO DEFECTIVE PRODUCTS

Each Customer must carefully inspect the package containing the products upon receipt, at the moment of delivery, and not accept the package or accept it subject to verification if the package appears to be altered or tampered with as Colpo & Zilio carefully packs all products in sealed packaging. In the event that the delivery has been accepted by an unauthorized signatory or in the event that the package shows signs of manumission, the Customer is required to immediately report the incident to Colpo & Zilio at the email address ordini@lisacolpo.it or by telephone at +39 0444380160.

If it is ascertained, in good faith at the discretion of Colpo & Zilio that the damage to the product occurred before its delivery to a Customer, or that the defect is not attributable to the use or damage by the Customer, Colpo & Zilio will repair or replace the product or fully refund the price paid. Provisions of the Italian Consumer Code, Articles 129 et seq. shall apply.

For returns due to damaged products, when it is ascertained that no damage is caused by the Customer, the costs shall be covered by Colpo & Zilio.

Notwithstanding the foregoing defects and non-conformities of the products purchased are considered accepted if not reported within two months following the delivery of the product.

RESCISSION RIGHTS

The Customer has a period of 14 days to rescind a Purchase Order and return the purchased products without having to provide any reason, by contacting Colpo & Zilio at the email address ordini@lisacolpo.it. The Customer must pay all shipping costs and applicable customs duties and other taxes relating to the return and such costs shall not be refunded;

Colpo & Zilio may withhold the refund of the applicable products until the products are received.

The products for which the Customer wants to rescind the purchase must be returned by the Customer to Colpo & Zilio in a new and unused state, in perfect condition, with all packaging intact and tags and stickers attached to them (if applicable), as well as with the original Lisa Colpo and delivery package, including all accessories and documents.

Products returned in conditions other and/or different than the one required from the paragraph immediately above will not be accepted, including if without the original packaging, documents and/or seals provided therein, and/or in a state other than that originally delivered (i.e. products that have been used, worn, damaged or soiled).

Colpo & Zilio reserves the right to verify that the products returned are conform to the requirements set forth above in this paragraph as soon as such products arrive at the headquarters of Colpo & Zilio, in Torri di Quartesolo (VI) at Via Gorizia 21, 36040 Italy; Colpo & Zilio shall not accept any returns that do not comply with the terms set forth herein without any further liability towards a Customer.

According to the provisions of art. 56 of the Consumer Code, Colpo & Zilio shall refund the price paid for the returned products, excluding shipping costs and applicable taxes, without undue delay and in any case within fourteen (14) days from the day in which Colpo & Zilio received the notice of rescission provided that, by that date, Colpo & Zilio has received the returned products and that these products meet the requirements of the conditions required by this Section 8 "Rescission Rights" (i.e. absence of damage and intact conditions of the products, its packaging and any related documents and materials). Otherwise, the refund will be suspended until the products are received by Colpo & Zilio . Colpo & Zilio shall make refunds using the same means of payment used by the Consumer for the initial purchase transaction.

Returned products that cannot be accepted by Colpo & Zilio because non-compliant with the requirements for the return under this Section “Rescission Rights”, will be sent back by Colpo & Zilio to the Customer and the related shipment costs will be debited to the Customer.

Notwithstanding the foregoing, the limitations/exclusions to the right of rescission of the Customer provided for in the Art. 59 of the Italian Consumer Code, shall be excluded for, without limitation, i) goods or services which prices are linked to fluctuations of the financial market outside of Colpo & Zilio’s control and which fluctuations may occur during the rescission, and ii) bespoke products; iii) the supply of goods which are at risk of deteriorating or expiring rapidly; iv) the supply of sealed goods not suitable to being returned for hygienic or health protection reasons and which have been opened after delivery; v) the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods.
